Background
During a Bronx narcotics operation in August 2023, NYPD Sgt. Erik Duran confronted a rapidly unfolding and dangerous situation when a suspect attempted to flee on a motorized scooter through a crowded pedestrian area. In an effort to protect fellow officers and nearby civilians, Sgt. Duran took immediate action and was later criminally charged following the suspect’s death.
The Legal Challange
Sgt. Duran faced prosecution on manslaughter charges in a highly publicized case that drew intense media attention and national debate surrounding split-second law enforcement decisions. After a bench trial in 2026, he was convicted of second-degree manslaughter and sentenced to prison, despite supporters arguing his actions were intended to prevent further harm.
NPDF Involvement
The National Police Defense Foundation established the Sgt. Erik Duran Legal Defense Fund to support his appeal and ongoing legal fight. NPDF partnered with law enforcement organizations and advocates nationwide to help raise funds for legal expenses, bail, and public awareness efforts surrounding the case.
Status
Following sentencing, Sgt. Duran was granted release on bail pending appeal as his legal team continues challenging the conviction. Supporters across the law enforcement community continue advocating for what they believe is justice for Sgt. Duran and his family.

The National Police Defense Foundation (NPDF) announced the launch of the Sgt. Erik Duran Legal Defense Fund following his conviction in a highly publicized Bronx case stemming from an on-duty encounter during a narcotics operation.
NPDF believes Sgt. Duran acted in response to a rapidly evolving situation involving a fleeing suspect and maintains that law enforcement officers deserve fair treatment, due process, and the presumption of innocence throughout the judicial process.
The Foundation is working alongside supporters across the law enforcement community to assist Sgt. Duran and his family with legal expenses, appellate efforts, and public awareness surrounding the case.
